Pennsylvania state prosecutors are asking that Jerry Sandusky's bail conditions to be tightened after receiving reports from local neighbors that the accused child molester has been spotted sitting on the deck of his house watching school children in a nearby playground.
In court papers filed Tuesday, prosecutors say there are "grave concerns" among Sandusky's neighbors about the safety of their children. They urge a judge to further restrict conditions for the former Penn State University defensive coach, barring him from "leaving the walls of his house for any reason" unless accompanied by a court officer.
The prosecutors acted after local school officials and neighbors complained that Sandusky was recently seen on the deck -- which overlooks an elementary school less than 50 yards away -- watching children play during recess.
"To think that he's up there, watching our kids and that's his new outlet, that's just creepy," Amy Hasan, a neighbor of Sandusky's, told NBC News in an interview.
Sandusky's lawyer, Joe Amendola, texted a reporter that the claim he's been watching school children from his deck "is a totally false statement" made by individuals who "will not be happy unless Jerry is incarcerated."
He added that "the law presumes Jerry innocent and Jerrry has always maintained his innocence."
Sandusky -- facing 52 counts of child sex abuse involving 10 children over a 15 year period -- has been under house arrest since his re-arrest last December, confined to his home with an electronic monitor around his ankle.

Amendola recently asked the judge overseeing the case, John Cleland, to ease his bail conditions to allow him to meet, e-mail and text with his grandchildren. Sandusky also wants the freedom to leave his house to accompany a private investigator to identify the homes of potential witnesses in the case. Amendola wrote that the grandchildren have expressed "sadness" about their inability to communicate with their grandfather.
But prosecutors strongly urged the judge to deny the request.
"House arrest is not meant to be a house party," they write in their court filing. They also noted that the ex-wife of one of Sandusky's sons "strenously objects to her three minor children having any contact whatsoever with the defendant."
A hearing on the bail issue is slated for Friday.

He's darn lucky to even be out on bail, and he wants more freedom! Knowing that the guy lives so close to a school would seem to grounds to NOT allow Sandusky to be on "house arrest".
The fact that he is a child molester and allowed to be free on bail-is quite disturbing to me. He ought to be locked in a state mental ward undergoing treatment-like castration and electric shock therapy. There is no known cure for pedophiles.
Why is he out on bail anyway? They need to find a 6'5" 300lb inmate who molested as a child and make Jerry his roommate.
I'm surprised this guy would expose himself (no pun intended) to the public eye in such a manner. If he can see them, then people can - and obviously do - see him. It wouldn't shock me to hear about him being picked off by a sniper from a few hundred yards away while sitting in a chair on his deck watching the children. Emotions run higher on child molesters than most any other issue. If abortion doctors can be murdered, then accused molesters might find it's open season on them as well.

Sexual or otherwise, I abhor child abuse as much as anybody. But... this man has not yet been convicted of anything. He is also not engaged in a dangerous, threatening or particularly odd behavior. If he were not accused of such a horrendous crime, I doubt anybody would find his presense on the deck of his house watching children play as remarkable.
I do believe in his probable guilt. But I also believe people are letting their emotions run amok with some of the "solutions" they are advocating.

Yes, Jerry has his constitutional rights...innocent until proven guilty. That's right. However, the evidence is so damning, especially the eye witness account of the horrible incident in the shower. The victims and potential victims have rights too. Just get him off the streets to protect the most vulnerable...without bail. He can face a jury of his peers afterward.

This is America. That's what a jury trial is for. We don't ruin someone's life until we've had a fair trial to determine conclusively (not emotionally) that they deserve it.

Most likely. Nearly every home in densely populated residential areas is near a school, park, mall, or some other place where children may congregate. This has actually proven problematic when laws are introduced to prevent past offenders from living near these places, including in Florida where several past offenders are homeless and live under a bridge that is the only spot for miles that meets the tight legal criteria. Treating people like this is not going to help them become productive members of society.

As to tampering with witnesses, I doubt that he and McQuery are on speaking terms, and I read nothing to suggest he has tried to contact alleged victims.
I'd prefer he was in jail already, and given the evidence, a trial may seem a mere formality. But it is an important one. So let's try and then lock him up and throw away the key.

And your point, Harold, is particularly true: forums such as this is the place where people vent their emotions regarding these emotion-provoking crimes. Dreamworld-man, the legal system has already determined this point: in most municipalities, child molesters are not allowed within a mile of a school. He has had a mentoring relationship with the children involved, he would be particularly likely to try and sway their testimony or to buy off the parents. There is no physical or financial barrier to prevent him from fleeing, or from otherwise denying the legal process in this case. He spends his leisure time, like Aqualung, watching the children, his neighbors children as if he were at a stripper bar, And yes, we do all have a right to a trial, but we do not have the right to continue to have access to victims waiting for trial. This guy should be in holding, not out, where he is a stones throw from hundreds of innocent children. What neither you nor Mr Pugh seem to realize is that while the trial system exists to protect the accused, the criminal justice system is (in theory) there in part for public safety. If he were caught with a pocket full of ecstasy, he would be in jail awaiting trial. So why not in this case?

That is "has had", as in past tense, Robin. This story does not report any attempts on his part to contact any of his purported victims, or any other witnesses.
This equally true of every person freed on bail and awaiting trial. If you had read the entire article, you might have noted that he is already under house arrest, enforced to wear an monitoring bracelet on his ankle, and is no way free to travel or to flee. He has nowhere to run to, and nowhere to hide.
What you fail to understand is that our criminal justice system is designed to protect the legitimate rights of all parties concerned: meaning the accused, the victim and the general public. The system is far from perfect, but in this case I fail to see where it has failed. The accused is awaiting trial and under house-arrest. There is no report of him attempting to contact any of the alleged vicitms, and while watching children from his deck may, for him, seem like a creepy activity, neither you nor I have any direct knowledge of his actual activity. He may have just stepped out on his deck.
...and I agree with Alan Pugh, very few people face an actual criminal trial for possession of ecstacy or other such drugs.

Good points by both of you, though the reason we (supposedly the reason) we have judges is to make appropriate decisions in each individual case. What do you think is going through Mr Sandusky's mind as he spend his idle time, watching those kids running around? Do you think he has picked out "special" ones? Sometimes, the actions of a person are so egregious (there were multiple witnesses) that the system must say"you have to wait for trial in holding" to prevent cases where perverts like this are left at arms length from other potential victims. So what if, like OJ he is exonerated in light of all of the damning evidence. Well, then I guess we all know where he's headed. Off to a romantic evening beginning at Chuckee Cheese. Thre only real "witness" in this case has contradicted himself several times.
The financial incentive for the others to lie is extreme. Any time there is a million dollar payoff from deep pockets riding on a guilty verdict every reasonable person has to suspect that witnesses may not be telling the truth.
No overt sexual act was ever observed. This much can now be determined from the flip-flopping testimony of McQueary.
It is not at all beyond credible or possible that the whole thing was concocted by McQueary and his own close circle of associates as a ticket to riches.
I, for one, do not find Sandusky's insistence of innocence to be disingenuous. In fact, his denial and the denial of his wife come across to me as very possibly sincere.
Wait for the trial. And even then, if the accusers walk away with any money at all, something's rotten and fishy here, and it isn't Sandusky.
Is McQueary a homosexual? Yes, it is a relevant issue.
Does/did he have a motive to make a false accusation? His testimony is the thing that stinks the most in all of the story that I have read so far.
The prostitute/maid in New York already proved to the public that one can get large numbers of people to believe an accusation of sexual misconduct, even when the accusation is completely far-fetched. Did the accusers in this case take their cue from that incident? Too much similarity here for my comfort.
We don't know what the truth is here. But it may not be what it appears to be on the surface. "Multiple" witnesses doesn't mean a thing when they're all salivating after a multi-million dollar payoff.
One particular witness is very telling, in my view. That witness has said that McQueary reported that he DID NOT see any overtly sexual behavior in the shower when he first reported "hearing noises" in the shower room.
Why did McQueary change his story? Look in that direction to find your crime, mr and mrs sherlock holmes.

You have to know that Sandusky was victimized as a child, these things don't just happen randomly and you can feel some compassion for the scary person he is now if you really try hard. "Innocent until proven guilty" is a legal viewpoint - the court must assume innocence until guilt is proven. I doubt there has ever been a time in US history where that was a social statement - gossip circles, scuttlebutt, yellow journalism, etc.
Sandusky doesn't do much to sway people from thinking bad things about him.

If these allegations were against you, wouldn't you want the opportunity to present your side, to try and prove the allegations false? If he is tried, convicted, and sent to jail, he probably will have to be in isolation, because I believe the convict code will otherwise take care of him, eventually.

Many years ago, I worked a shift with a man who had just received a jury summons. Long story short, he was excited about the chance to send someone to prison. One of the other guys asked him, well what if the accused was innocent. He said, in words that haunt me to this day, "If he was very damned innocent, he wouldn't be there in the first place."
I urged him to be sure to express that feeling to the court when they were doing jury selection. I only worked with him that one day and don't know if he was selected for jury duty. I sure hope not.

@Mr. Arnold C: I was once on a jury for a trial of a man (actually an older teenager) accused of a violent crime. He was a minority. Couldn't believe it when another member of the jury said something like, "Doesn't matter whether he's guilty; you know guys like him have done something before but just wasn't caught or, worse, he'll certainly do something later." In this case, there was enough real evidence that proved guilt, but that juror frightened the heck out me.
I think it's reasonable that Sandusky should be kept on close house arrest. Of course, he's innocent until proven guilty, but I wouldn't want him staring at my grandchildren - he and his lawyer should have known better.

I think he did it but at the same time.... I was almost raped when I was 10. I didn't even know what s e x or ra pe was but I fought back like a wild animal and escaped with boodyhole in tact. He fkd me up pretty good but that busted nose of his was very telling. The next day they found the guy tied to a tree behind his house with both his knee caps broken by who no one knows. I know who did it though. The same person who picked me up from school for then on.

The same thing happen to my brother but unfortunately he wasn't as lucky. We was molested several times unbeknownst to any of the family. I have no tolerance or patience for this kind of treatment to an innocent child.

Well, look what good it did when he was caught red...well, in the act???? they didn't tell because he most likely threatened them, they knew their parents would be upset, no one would believe them, they would lose all the privilege of being with a famous person they once admired, he was an authority figure and famous, they were hurt and scared, afraid parents would get hurt or he would tell everyone they made it up, adults don't like to believe this stuff happens, they were kids and had no self-confidence or likely the voice to tell....shall I go on???? Add that we don't know if anyone did tell along the way and it was covered up and I think you have plenty of reasons.
Geez, a guy walked in on one poor child being raped and no one did a da**ed thing. He could have told the kid that see? He didn't stop me so it really is love and okay. I can add one more reason why some kids don't tell, because they don't want the stigma of being a victim the rest of their lives and having to relive every horrible detail over and over - to their parents, to investigators, to the courts, etc.

Really, ask Joe Paterno and Mcwhatever his name is. They were adults and handled it horribly, and apparently everyone else did too. I agree this guy is entitled to due process, but for sake of children he needs kept at bay and reminded that people are watching his every move. Sandusky's home and back yard shares a border with this park, so he's entitled to be on his own property. It is not unusual for someone to sit on their deck, but during winter makes one think the pedo is doing what pedo's do.

Our entire legal system is an absolute mess. First off, how does this guy get to 1) be out on bail, and 2) be out on such a low bail. If any other citizen was charged with 1/10th of what this coward is charged with, I guarantee that there would be NO bail....as there shouldn't be. When it comes to crimes against children, there should be NO favorable sentencing/leniency on any level or stage of the legal process. The article says neighbors see him "watching children play" from his porch. SCARY STUFF right there.
