The Justice Department has sent a letter to dozens of local law enforcement agencies in Alabama that receive federal money, warning them that they risk losing that funding if they're not careful in how they enforce the state's tough new immigration law.
The Obama administration has already sued the state, claiming that the law is unconstitutional. Now it's keeping the pressure on by addressing how the law is carried out.
The law, HB56 passed by the Alabama Legislature in June, attempts to combat illegal immigration by establishing harsh penalties for employers who hire undocumented workers, requiring public schools to report children and parents who are not legal residents, and forbidding illegal migrants from having any transactions with the government. The law creates new immigration crimes, and puts local police in the position of enforcing immigration.
Federal justice officials were in Birmingham last week to investigate the civil rights impacts of HB56, which is designed to make it extremely uncomfortable, if not impossible, for illegal immigrants to live in the state. Among the officials was Thomas Perez, assistant attorney general of Justice Department’s civil rights division.
In an unusual letter addressed to 156 Alabama sheriff's offices and police departments, Perez tells them that the federal government is monitoring how they enforce the part of the law that requires checking the immigration status of people who are stopped for questioning.
It is critical, Perez says, that local law agencies "ensure that your enforcement of this law does not result in unlawful stopping, questioning, searching, detaining, or arresting" in violation of the Constitution "or targeting of racial and ethnic minorities."
Other states have passed similar laws, but they've been blocked by federal courts. A federal judge in Alabama, however, allowed the law to go into effect.
State Sen. Bill Beasley, a Democrat, is leading an effort to repeal HB56 in the upcoming session.
In the meantime, there are forces aside from the federal government chipping away at various provisions in the law.
Courts have put some provisions on temporary hold, including Section 13, which makes it a crime to transport or shelter an undocumented immigrant — putting many charitable and religious operations at risk of prosecution.
A court also enjoined Section 28 of the bill, which requires school officials to inquire about the legal status of public school children and their parents. The ruling came after the state’s Education Department reported that more than 2,200 Latino students, were suddenly absent from school.
The bill was touted as a way to provide jobs for Alabama’s legal residents amid a tough economy. There has been a backlash from the farm, poultry and construction industries, which started seeing an exodus of Hispanic workers — including many with legal status — after the bill was passed.
In the late summer and early fall, Alabama farmers who lost workers were unable to get their tomatoes, potatoes and other labor-intensive crops in time, and watched them rot in the fields.
“I certainly don’t feel the Legislature wanted legals leaving Alabama,” says Jay Reed, president of the Alabama Associated Builders Contractors, and co-chair of a group called Alabama Employers for Immigration Reform. “However, that is the case. For right at 30 years, employers have followed the hiring guidelines and to change that overnight left a void in Alabama’s work force."

The Feds fail at their responsibility of immigration and then threaten to take away the money that you paid for them to do the job. Irony at its best.
Don't enforce the laws to protect your state because the Feds failed to do it or we will take the money you gave us and not give it to you.
DO YOUR JOB FEDERAL GOVERNMENT OR THE STATES WILL DO THEIRS AND KEEP ILLEGALS OUT.

Alabama could drop most of the law and still be effective! If they diligently audit each and every business and fine the heck out of those not in compliance, the illegals will be forced to leave for lack of jobs.
Also the contracts part of the law should be enhanced in that any company found hiring illegals through non-compliance of the law, will not be able to receive any state or municipal contracts for 6 months for the first offense, a year for the second, and blacklisted after that.
The law was not intended to round up the over 100,000 illegals in the state but rather to force them to move for lack of income and entitlements. Once they move they are the next state's problem and they would then have the choice of following suit and enforcing their own laws or be a sanctuary for all illegals self deporting from those states that do pass the laws.
Do you understand how Federal law works? The Justice department is well within its rights to send the letters that it did - this is also part of Federal law. It's interesting how you have a problem with Federal law, and yet claim to wish to see it upheld.
I only hope that Alabama can hold on until January 2013, when the Justice Department will be taking its orders from a loyal US citizen again.
What I find hilarious is that all these "hug an illegal" groups and all these illegals advocates piss and moan because Alabama has passed this law and they want all their supporters to show up for a march or rally in the largest cities in the state and can't get more than 3 or 4 hundred people to show up, and most of them don't even live in the state.
They had a rally in Huntsville, really big turn out....... all of about 2 dozen people.
Gutierrez and his band of idiots came and only about 4 or 5 hundred people went to listen to their BS. There were more people at the BOAZ (very small city) Christmas Parade than went to that rally!

The fact that this administration has deported more illegals then any in the past seems to show that the Feds are working the problem. I would suppose that some of you would think that the harassment of a few legal immigrants or citizens is worth it. The government is warning not to violate a citizens rights. What is wrong with that? What ever happened to the principle that it is better to let 100 guilty go free then to incarcerate one innocent man.

You do know that Alabama didn't mandate E-Verify for all employers- until this year? Do you know there are only 18 states that actually mandate E-Verify in some form? This is the only part of the State law that makes any sense. Fine the employers.
Which party is advocating for even lower taxes on corporations? Which party wants to perpetuate hiring illegal aliens and forgo receipt of taxable wages, safe working conditons and a minimum wage? The pilot program for E-Verify started in 1996 and was expanded to employers in all states in 2003. There are only 18 states that actually mandate E-Verify in some form and it only takes 72 hours between the Social Security Administration and the Department of Homeland Security to determine if a prospective employee is a legal citizen.
Do you know what GOP organization has fought tooth and nail against E-Verify and have filed lawsuits against it? Why none other than the GOP led U.S. Chamber of Commerce. Now,who really wants to hold employers accountable?

Suffice it to say that if the federal government would do its job there would not be over 12 Million ILLEGAL immigrants in the U.S. Further, if the federal government did its job by enforcing its own laws, once an ILLEGAL immigrant is apprehended, the government wouldn't release the individual. Further, the Obama Administration should NOT be requiring ADDITIONAL LAWBREAKING before it enforces its own laws.
Current federal law sets the number of immigrants at a limit of 700,000 per year. A circumvention of that Congressionally-mandated directive represents a subversion of federal law. In America, Congress passes legislation which must be (and was) signed by the President. Presidents do not have the legal authority to circumvent Congressional enactments.
For the record my buddy, who is a BPA, informed me that deports are down, however they are getting "record" numbers by counting those caught at the boarder as deported. This has never been done before until Janet Napolitano took over DHS. Pretty much they are cooking the books...

You do know that Alabama has been controlled by the Dems and the teacher's union until the last election. First time the Reps had control since reconstruction. Which is why it wasn't until now that E-Verify is being used, probably because the Dems didnt want to run out a pro-Dem voting bloc.

Enough of the fed trampling the states rights to defend its laws. We need a Constitutionalist as President. How much longer can we let this go on. Please look at Ron Paul. He has the only solid voting record as a constitutionalist and has not been swayed with bribes of easy money. We gotta start choosing our candidates closer and start voting in the Primaries. Only 8% of us voted in the last primary and that vote was divided by all the candidates so a 2% vote puts the winner of each party on top. That's horrible. The delegate votes that are powerful are even worse. Only 2 countrymen from my district showed last time. How is that taking our country back? In one the feds are putting the pressure on Alabama for doing their job (immigration law), and on the other hand cracking down on states with legal medical marijuana dispensaries via the DEA. Our federal government needs to be overhauled, they have absolutely no regard for states rights.

It's actually more than one innocent, they are detaining, harassing, and deporting legal US citizens in their haste to 'deport all ilegals'. See the below cases. Do a google search on the names--I can't get links to stick.
Rennison Castillo, a Washington state man who was born in Belize but took his oath of citizenship while serving in the U.S. Army in 1998, spent seven months in an ICE prison in 2006. Castillo, 33, of Lakewood, came to the United States at age 6 and later became a permanent lawful resident. He was sworn in as a citizen during his seven-year stint in the Army, which ended with his honorable discharge in 2003.
Lack of proper training of immigration inspectors resulted in their mistaken conclusion that Sharon McKnight’s passport was fraudulent. McKnight spent eight days in Jamaica before returning to New York. While there, her luggage, containing all her money, was stolen. Airport workers contributed money so she could reach family members. Once there, her mother flew to Jamaica from New York to take her case to the US consulate in Kingston. With the help of Rep. Michael Forbes (D-NY), consulate officials determined that the passport and birth certificate, which immigration officials had declared fraudulent, were in fact real, and established McKnight’s US citizenship.
The son of a decorated Vietnam veteran, Hector Veloz is a U.S. citizen, but in 2007 immigration officials mistook him for an illegal immigrant and locked him in an Arizona prison for 13 months. Veloz had to prove his citizenship from behind bars. An aunt helped him track down his father's birth certificate and his own, his parents' marriage certificate, his father's school, military and Social Security records. After nine months, a judge determined that he was a citizen, but immigration authorities appealed the decision. He was detained for five more months before he found legal help and a judge ordered his case dropped.
Mr. Ibarra, 46, was born in Mexico but was raised since infancy in Arizona. In his late 20s he enlisted in the Marines and served three years on active duty, including time in Iraq, before being honorably discharged. On February 23, 2011 Department of Justice adjudicator Richard Phelps ruled in Eloy, Arizona that George Ibarra had by a preponderance of the evidence proven that he is indeed a citizen of the United States. Rather than apologize to Mr. Ibarra for previously wrongfully detaining him, the Department of Homeland Security (DHS) is holding Mr. Ibarra in solitary confinement at the Eloy Detention Center, in clear violation of the U.S. Constitution and a memorandum requiring Immigration and Customs Enforcement (ICE) to release anyone with "probative evidence" of U.S. citizenship.
So GCal, not all the people ICE has deemed 'illegal' actually ARE illegal. Most people would agree that anyone who's served honorably in our military has earned the right not to be treated this way; especially in Mr. Hector Veloz's and George Ibarra's cases, where judges ruled that they proved they are citizens and ICE continued to hold them anyway. Indefinite detention without trial or charge is a clear violation of constitutional rights.
Oh, and now the Senate and the House passed the NDAA act that makes this applicable now to everyone, even American citizens on home soil. If you're suspected of supporting or aiding terrorists or committing an act of domestic terrorisn like stockpiling food or 'spreading the enemy's narrative' (i.e. distributing written material that runs counter to the US and it's allies' military interests) you can be arrested by the US military and held in military prison indefinitely without trial, charge, or lawyer. Google NDAA.

I seriously hope you are not naive enough to believe that the few illegals being deported is anything but smoke and mirrors. If you add together all the deportations all the administrations have done in the past 25 years, it doesn't amount to anything compared to the 10-12 million illegals in the country.
If the Feds were anything close to serious about illegal immigration, they would start fining and jailing those who employee them. Soon no one would hire an illegal and they would all self-deport. And stop coming here in the first place as there would be no incentive.
Health warning: Don't hold your breath waiting for the Feds to do anything substantial.
Amanda, I'm not sure what your point is in posting that some mistakes have been made while enforcing immigration laws. Is it that we should stop enforcing the laws until we are certain no mistakes will been made? I certainly hope that's not your premise, because that would be like saying we should stop arresting murder suspects because the wrong person has been arrested in the past.
@ Amanda - All those cases were federal cases. It sounds like they need to send that letter to themselves. On the other hand maybe it's time the states took that job over. The feds seem to try to pass the buck and are trampling the rights of US citizens to boot. Let's take it out of their hands. Let them all move to the sanctuary states that apparently want them and away from the states that don't. Everyone's happy.

Sorry but that statistic has been shown to be misleading. The increase in deportations has is because of INS check points. In an interview Obama lamented the fact that he couldn't do anything about those. In that interview, he took no credit for the increase and explained that he couldn't do anything about captures and deportations of people from the boarder patrol. He has actually cut down the number of people deported that have made it past the boarder patrol's jurisdiction.
They are ILLEGALS if the federal government won't do their job then thankfully a few states will.
If the federal government wants to just open our borders to any and everyone they need to come out and say it instead of being so passive/aggresive. Then we (all the unemployed, debt ridden, we the people) will deal with it.

My point is that in their haste to 'deport all illegals' ICE is ignoring citizens' rights. The US Supreme Court and the Justice Department say that ICE has to let somene go after they prove citizenship, and keeping them detained after that ruling tramples on the righs of citizens like Mr. Veloz, and Mr. Ibarra. And in cases like Ms McKnight's, the haste to deport led the ICE official to a clearly erroneous conclusion that her birth certificate and passport were fraudulent. The system needs reform.

That I will agree with completely. They need to be more careful and they need to stop operating under the assumption of 'guilty until proven innocent'--our whole legal systems is built on 'innocent until proven guilty.' Before we can start talking system reform we need to change the way ICE looks at 'illegals'. And the American public needs to understand that not everyone ICE says is 'illegal' actually is illegal.
What a suprise, the federal government threatening to withhold funds from a state trying to do what the feds won't. The classic response anytime someone challenges them, going after the pocket book.

Chris, there have been many studies on the economic impact of illegal aliens in the country. Do they cost more than they are worth to the economy or are they beneficial? It depends on what statistics one uses that determines the results, but overall the consensus is that there is little or no benefit to the economy. Consequently, ridding the country of illegal aliens would have no significant long term affect on the economy.

I don't just read one article written by one idiot that works for one liberal media outlet and think that I might know a fact or two. Im from Arizona and I know for a fact lettuce prices didn't go up. I have family in Alabama and I know for a fact that tomato and potato prices didn't go up!.
In fact 15lb bag of russet potatoes in Alabama store right now is under $5. Tomatos in Alabama have stayed at $1.49 a pound for well over a year. Comparing those to several grocery specials in several different states shows that those prices are the same or cheaper than neighboring states that don't have the immigration law yet.
As for white people lasting a few days. The fact is most of the farmers in Alabama never tried to get legal residents to work.

Did you read or see the article about the poor Alabama pickle farmer that was afraid he wasn'tr going to get his crop picked? It was here on MSNBC and that Brian Williams show. If you didn't go read the story for yourself but then do a little research and you will find that the author and the 'poor farmer' also receives over $75k a year from the tax payers in subsidies. That is money above and beyond if he grows a crop or not!!!!!

How about the one in Texas where an illegal has run up over $1 mil. The same with the illegal in New York with over $1.5 mil in hospital bills. Or the illegals using dialysis in Georgia. Prices aren't going up and if you had a clue about economics you would know that the cost of labor is very small and even if it was doubled would only cost a few extra pennies to the consumer.

As for boycotts, damn are you really that unread. Look at Business week and its projections for the businesses that are lining up to get started in Alabama. For the next two years they are projecting over 10,000 direct high tech and auto manufacturing jobs. The fallacy that the illegal alien issue cannot be tackled due to logistics, courts, etc. and associated costs is just that, a fallacy. Currently, many cities in northern Mexico are having problems taking care of the illegals coming back home because there are no jobs for them in the U.S. due to the economy. That's right. The illegals self-deported on their own because there was no job for them and consequently no incentive for the them to stay. Crossing have decreased as well for the same reason. The incentive for them to come here has drastically diminished.
It's blatantly obvious to anyone but the totally clueless that the problem can be resolved simply by destroying the incentive for them to be here. It's simple, start fining every single employer that hires an illegal. Once the word gets out that it is going to cost your business more than it can benefit from hiring an illegal, no one will hire them. There will no incentive for them to stay, and, more importantly, no incentive for them to come here in the first place.

McKnight spent eight days in Jamaica before returning to New York. While there, her luggage, containing all her money, was stolen. Airport workers contributed money so she could reach family members. Once there, her mother flew to Jamaica from New York to take her case to the US consulate in Kingston. With the help of Rep. Michael Forbes (D-NY), consulate officials determined that the passport and birth certificate, which immigration officials had declared fraudulent, were in fact real, and established McKnight’s US citizenship.
Blanca Catt, who at 19 still lives at home, wants to join the military. Instead she lives in fear she'll be deported. Catt, born in Mexico and smuggled into the U.S. as a toddler, was seized from abusive parents by the state of Oregon and placed into foster care with the Catts when she was 5 years old. The Catts adopted her three years later and said caseworkers told them their daughter automatically became a U.S. citizen.
That was not true. Now Catt is caught in a bind. Since she has turned 19, she faces tough penalties for being in the country illegally. Lisa Catt, Blanca's mother, is frustrated that state workers never completed the paperwork and then failed to tell Blanca's adoptive family of the omission.
Christopher Zambrano was biking near his home when one of several men in black clothes riding in an SUV ordered him to stop. As he got off his bicycle, Zambrano heard the man ask for his papers.“I said, ‘What do you mean papers?’ He said ‘ID.’ I told him I had nothing on me, not even a driver’s license, becuse I'm just riding a bike on the street near my home. Zambrano said he was a citizen, but the men who detained him refused to release him. They summoned a Miami-Dade police officer who then transported Zambrano to jail. Zambrano has a U.S. passport and a birth certificate issued in Atlanta, where he was born of a Guatemalan father and an Irish-Polish mother. However, he was not carrying those documents when he was detained because he didn't think they would stop him while riding his bicycle.

I do have an opinion and some case law behind my opinion. It is federal jurisdiction to enforce Immigration Law. The state of Alabama nor any other state has the right to write their own immigration law or to administer Federal law as they see fit.

Answer this did Congress pass Article 287 g of the Immigration and Naturalization Act?
Did Congress start the secure communities program?
If you answer yes then you are admitting that the fed opened the door for the states to become involved in the administration of the laws as they pertain to illegals.
If you answer no then you are ignorant of the facts and need to go back and do some research.

Alabama is doing nothing but actively enforcing federal laws. If you're here illegally, you should not be here, period.
It's pretty incredible how many people here say things like "if the Feds only did their job, Alabama wouldn't have to do this" or "all Alabama has to do is a thorough audit of all these businesses." How is Alabama supposed to pay for rigorous audits when you xenophobes are so staunchly anti-tax, citing the argument that big government is a money hog and can do nothing right? It sounds like you all are asking for big government with laws like this, and expect the government to magically come up with the money to somehow pay for it. Hypocrites. You say the federal government needs to do its job, but at every turn, try to cut funding for the fed. You say you don't want big government in our lives, yet here you are, demanding a police presence stopping anyone they suspect of being brown and illegal. I just don't know how you all can rationalize your views with your heads popping.
Mainly because the government is rampant in wasteful in spending. Overlapping spending, funding of projects which have absolutlely no benefit to you or I, slush funding. That is the reason we are against taxes, at least that is why I am against it. The money should be spent on the things than benefit the US taxpayer. Also, the federal government DOES NEED TO DO ITS JOB as specified in the constitution. But then a Fleabagger will never understand.
Actually we just want the federal government to get out of the way. Let the states enforce the laws and quit suing them. If the feds don't want to enforce the laws then at least get out of our lives and let us enforce them locally!

The States can't enforce a federal law. Immigration is federal and the states have no jurisdiction. They need to push their Congressmen and women (yeah, that'll work!) to get moving on immigration reform. These states think that they're being tough; in reality, the Constitution defers immigration to the Fed. Govt.
I don't have a problem with that SacredFire....only problem.....the Feds are not enforcing immigration. In other words, illegal border crossing continue to happen every minute of every hour. Should I repeat myself....The Feds Are Not Enforcing Border Control which is a part of immigration.
Wanting to get rid of just illegal aliens is not being xenophobic. Wanting to get rid of ALL foreigners would be xenophobic.
The Constitution does NOT defer immigration to the Federal Government. Immigration isn't even mentioned in the Constitution.

Have you ever been through a check point in Alabama, Georgia, Arizona, etc. It wouldn't take that much to audit businesses. South Carolina has been doing it and on a scale that matches the entire out put of audits that the Fed has done in a year. It would be a lot less costly to have several people auditing the books of businesses than it would, paying for incarcerations of thousands don't you think?
As for on the federal level, they could redo the tax laws which would mean not needing all the IRS agents. Those agents could be used to audit the businesses thereby not increasing our already over bloated government and actually doing something to benefit the legal tax payers of this country.
