Police: Man viewed child porn on US flight

BOSTON -- Police say a man who was viewing child pornography on a domestic airline flight from Salt Lake City to Boston has been arrested.

Massachusetts State Police say 47-year-old Grant Smith was sitting in first class Saturday afternoon when a fellow passenger saw the pornographic images on Smith's laptop and alerted the flight crew.

When the Delta flight landed at Boston Logan International Airport at 4:12 p.m., troopers interviewed Smith and subsequently arrested him.

He has been charged with possession of child pornography, and police say additional charges could follow. His bail is set at $15,000. He is scheduled to be arraigned Monday.

Smith was in police custody Saturday night and couldn't immediately be reached for comment. NBC station KSL of Salt Lake City reported that Smith is from Cottonwood Heights, Utah.

Not only is this guy scum of the earth, but he has also got to be one of the dumbest people alive. Viewing his illegal child porn collection on a plane where there is no such thing as privately viewing anything on your laptop was just asking to get caught. Porn is about profits - if women are willing to kill their kids so they can get a new boyfriend - then it stands to reason they would also accept money from pervs so they can film their kids.

My wife works for CPS - just as many screwed up females as there are males in the world. We keep cutting funding that helps these kids, not like we are innocent bystanders.

Brenda - While I certainly agree that this man deserves punishment, and also a CAT scan of his brain to see if anything is up there besides white mice on a treadmill, I do think the people advocating life in prison and castration as punishment are losing their perspective.

While I do not believe that the Constitutional prohibition against "cruel and unusual" punishments refers to the death penalty, it certainly does cover castration. And as to issuing a life sentence, I would say it is disproportionate for the crime of viewing child pornography. If they were prosecuting those who actually made the pornography, yes, I would say a life sentence is in order.

I'm with Shadow and Chris. We know, at this point, absolutely nothing. It is often ignored that we have prosecuted people in this country for "child porn" when what they had was simply adult porn in which one idiot thought the actress was under 18 (Little Lupe) and when they were just developing pictures of their own children in the pool. Take a look at what that second family went through and rethink the calls for castration before the man has even had his day in court. We simply do not know ANYTHING yet.

          Since the child-porn law is so broad that anyone viewing child-porn is in violation of the law, any bystander who has taken the time to ascertain whether the video images were indeed child porn should also be similarly charged except for possession.

          It would be interesting otherwise. All anyone would need is one child pornography picture, and nobody would ever be able to take legal action against them. Go to court, take it out, and everyone in there will need to be arrested for seeing it.               Robert - Before you execute this person would you be interested in knowing what he did, or if he was actually guilty? For all we know he was looking at pictures of his 6 month old child being bathed by his wife. Maybe it was a computer virus that redirected his computer to child porn sites without his knowledge or consent. Maybe he's a pedophile who should be locked up. I don't know which of these are correct and neither do you.                 If I were on a plane (or anywhere else) and if some unexpected child porn, popped up, I would slam the lid IMMEDIATELY. I might even utter an expletive such as Holy Schit!! And refuse to show the picture I was saying it about. And then I'd remove the battery and store my laptop until I got home where I could figure out how to get rid of the offending pictures/videos permanently.                   churchmouse3, that's a sign of someone who lives in fear of a society that has abandoned common sense. There should be no need to slam the lid of a laptop closed. In the unlikely (but not unheard of) event that a nude picture of a child (or a teenager) popped up on my screen, I would glance to see where it came from (local folder, URL, etc.) before closing it. That's the rational thing to do in order to prevent future issues.

                  That's an easy explanation. As a certified computer technician, I was attempting to find and eradicate the virus. Unfortunately, while executing my anti-viral procedures, I was constantly interrupted by the pop-ups the virus was putting out, and also by my side-seat airplane companion, churchmouse3, who was continuously yelling at me for the virus on my system that I was attempting to eradicate.

                  Sadly, viewing a mere photograph constitutes nothing -- but simply viewing a photograph.  While it may inherently infer that one engages in a particular conduct specific and/or related to the material being viewed, it bears no valid argument that the viewer is guilty of anything, other than simply viewing a photograph. Perhaps a friend or family member saved the image on said device (laptop), and to the shock and dismay of the owner, it was inadvertently discovered on said device (laptop) at the moment when a third party witnessed the viewer in the act of discovering that the photograph existed.  The moral of this story is that you cannot judge a book by its cover.

                  Unfortunately, the law doesn't treat the viewing of all photographs the same way. Where the photo involves a child and certain sexual elements, the law considers such images child-porn.

                  Child porn is a hot button issue, today. The possession of any images of child-porn is a violation of the law whereas the possession of the most wicked adult porn is permitted. While American society has accepted the viewing of photographs and videos of adult porn, it has decided that any porn images involving minors is a crime.

                  Hence, today, the law has treated certain images as inherently evil with no social redeeming value. This brings to question whether the Islam fanatic's prohibition of the drawing of an image or viewing an image of Allah is blatantly illogical or unAmerican. In certain nations, the viewing of an image of Allah is also punishable by death or incarceration. In both examples, the verdict are the same: guilty by looking at an image.

                    The problem is that its such an issue ...it is used as an aide for revenge and agression more often than some may think...especially in heated divorces and bad relationship splits and the line between a harmless picture of a child and a true vile and definately sexual image becomes extremely vague at times. We rely on law enforcement to make the proper determination in case's like that ...but sometimes they do and sometimes they don't and because the law enforcement agents are people with their own oppinions and their own personal greiavances what you might get ....a righteous arrest or one that is questionable,is a toss up.

                    My wife had me take a picture of her and our daughter when she was four years old,they sitting in a tub together...she was washing the childs hair,both of them caked in suds and laughing with little rubber duckys floating around...a completely innocent picture,that captured a joyous and precious moment between a mother and daughter and no where near suggestive or sexualized..... as are the constant stream of ads we see on television and billboards every day.....depictions of child models in bating suits and sexy clothing worn by girls who have not even started puberty yet. But because of some truly petty disagreement she had with a coworker of hers ,who she'd shared family pictures with on occasion as people do...we ended up with DSS and the local and staTe police departments at our house one morning searching closets and drawers and computers. We gladly showed them all the photos of our child and let them look in every nook and cranny and that should have been that ...but they persisted for over a week until they were grudgingly satisfied there was nothing afoul. It was as if they were dissapointed to find no crime. I know of another person who went through the same thing because he caught a secretary red handed stealing office funds and she retaliated by calling the porn cops to duck the issue...it didn't work!

                    Its a double standard in this country ...sex sells everything from cookies to colas and its o.k. for children to be sexualized in the clothing industry and movies at will... as long as there is profit in it and America keeps spending money...but after that its a sin to even look at a childs bare legs to see if they have a sunburn. This country has the worst case of rampant and uncontrollable hypocrisy that ever existed. Until there is a clear and indisputable definition of child porn...that anyone can look at and know is criminal...I'm not buying the comdemnation of anyone until all the facts are in!!

                        DIOUF ~~ On some level, I do agree with you. I have good friends who are gay, and they would in no way passionately kiss each other IN PUBLIC, but only behind closed doors. I wouldn't want to see even a heterosexual couple making out on a plane, and I certainly don't want to catch a glimpse of ANY kind of porn, especially KID PORN, while in flight, at the coffee shop, at the park, or in my office. And if anyone is in to smoking pot, doing so on a plane would be stupid and of course it is illegal, just as kid porn is illegal.

                                      Sadly, the government counts on the frantic, hysterical useful idiot fringe to help propel its child porn which hunt.

                                      For the government, child porn has turned into one of the biggest growth and civil liberty trampling opportunities it has ever had. Child porn has launched a thousand tax funded or tax exempt "help the victims" type programs, not to mention the many billions the government has spent on creating or lavishly beefing up its own programs. I'm sure it would not be much of an exageration to suggest that 10,000 government paychecks are behind every kiddy porn bust.

                                      The type of bust that generated this article is, basically, typical, i.e. some private citizen caught the guy looking at kiddy porn on his computer, and reported it. In the overall scheme of things, these busts are just low hanging fruit. To me it seems that for about the past 6 or 7 years it is common to hear about new busts every few weeks. But, it is very, very rare to hear about a bust involving someone who was actually producing the material.

                                      There is a lot of stuff we are not being told by our government. For example, most of the "so called" child porn that is produced in this country, is being produced and distributed by the kids themselves; it's called "sexting". Also, a high percentage of the "porn" is really not even pornographic, it simply involves underage nudity. And, a very large amount of the material dates back to the 1950's and 60's when the stuff was legal and even then, as now, hardly any of it was produced in this country.

                                      I am not even slightly tolerant of child abuse, in any form, but neither am I in favor of grossly missleading and finacially bloated govenmental whitch hunts. As I see it, for all the money, hype and effort, the government has produced some great headlines and plenty of new ways to spend billions of dollars. They have destroyed the lives and thrown many thousands of otherwise productive men into prison, but they have hardly rescued any child victims. Because, in truth, there aren't that many. And yes, of course, one victim is one to many.  

                                      So, I'm sure the guy who wants to shoot anyone who looks at the picture will now want to shoot me for dissagreeing with his sense of justice.                                       I mostly agree with you. I don't care nearly as much about who looks at child porn, sure there is something wrong with them, but that part of the act doesn't directly harm anyone. I wouldn't completely legalize it, but they are not the real problem. It is the sick sobs that produce the stuff, and anyone funding it that needs to hang.

                                            The legal definition of child pornography (legal, not dictionary) says that nudity by itself is insufficient. Pictures of naked kids does not equal porn. Otherwise every picture of a baby having his first bath would be illegal.

                                            To be illegal, the pictures have to either depict actual sex acts, or else be overly "sexualized." Which is a maddeningly vague term. It's one of those things that you tend to know it when you see it. But it's a gray area that has permitted certain shady industries to exist. You can, for example, buy videos of nudist families including kids of all ages. The argument is that this isn't porn, it's just people who participate in a particular lifestyle who happen to be taking videos of everyday, non-sexual activities.

                                            Of course, since there's a big market for non-nudists buying these videos, it's obvious to anybody with common sense that something else is going on. People are not buying the videos as non-sexual videos about the nudist lifestyle, they're obviously buying them for other purposes. It is the thin veneer of legitimacy that allows the industry to survive.

                                            But still, any normal person who sees a naked child won't feel aroused. In most countries they allow small children to run around naked at the beach or pool for instance, and are horrified that Americans think this is sexualized behavior. "They're just children, what are you talking about? Are you all perverts in America?" They argue that if a pedophile is aroused by the naked children, it's because he's a sick person. They see no reason to rearrange their norms so that sick perverts won't get aroused.

                                            In America, we view it as a safety issue. We worry that somebody will view our children sexually, so we make sure nobody ever sees them naked. For their own protection. We worry that a pedophile might fixate on our children and kidnap them.

                                            This is fairly recent actually. If you look through old magazines, like from the 50s through 70s, nobody thought like this. There are naked babies and toddlers showing everything -- even in things like ads for baby powder or diapers. Nobody thought about that. It's a picture of a child, therefore it cannot be sexual. End of logic.

                                            It is a different world now, but we haven't re-written the laws. Especially with the Internet, we have to assume that even an innocent picture of an unclothed child is being primarily viewed and downloaded by pedophiles. Does that mean we should make such pictures illegal? I don't know. I'd rather get rid of all the people who are aroused by such pictures, and feel secure knowing that nobody who sees it is thinking that way. But that's not exactly feasible -- you can't tell what's going on inside somebody's head.

                                            I maintain that an ordinary person does not look at pictures of naked children and think "that is porn." An ordinary person is not aroused by such pictures, or by any children at all. Sex doesn't enter into a normal persons mind when they're looking at children, naked or otherwise.

                                            I want to live in a society where people who are aroused by children get help, or get locked up. Not necessarily in that order.

                                            I don't like thinking I live in a world where if my kids are doing something amazingly cute, but happen to have a naked butt, that I can't take a picture without worrying that anybody who sees it could call the cops. That's a scary world that makes me sad. :(

And, I'd like to add to that - and I'm assuming here - that a pedophile can get aroused from a photo of a child, even if they are NOT naked or doing something that appears sexual. Just like any heterosexual male can see a fully-clothed attractive female, and become aroused. All he has to do is imagine her naked, or image what he'd like to do with her.

                                              I think that now that there's an awareness that there pedophiles out there, as parents, we should avoid posting our children's photos in social media contexts, especially the bathtub photos. Every parent has a photo of their baby taking a bath - some taking a bath with a parent. This is perfectly natural and normal. It is intimate, but not at all sexual. We just need to make sure those photos are shown only to close family members whom we trust.
